Australia Student Work Rights Guide for Nepali Students explains the 48-hours-per-fortnight limit, when work can start, scheduled-break rules, research-degree exceptions and the workplace protections available to every employee. What 48 hours a fortnight means
A fortnight is a 14-day period. During study terms and semesters, most subclass 500 holders can work no more than 48 hours in that period.
Do not average excess hours across a month. Keep a daily record across the employer’s roster, payslip and personal calendar.
Course in session includes exams
Study Australia says the limit applies during terms and semesters, including examination periods. A week without a classroom session is not automatically a scheduled break.
Use the provider’s official academic calendar and ask for written clarification when dates are unclear.
Work before the course starts
A Student visa holder granted offshore normally starts work only after the course begins, unless another visa condition permits earlier work.
Arrival in Australia, orientation or obtaining a tax file number does not by itself activate work rights.
Scheduled course breaks
Unlimited hours can apply during an official scheduled course break. The break must belong to the course schedule, not a personal decision to skip class.
Confirm the start and end dates and return to the 48-hour limit when study resumes.
Master’s by research and doctoral students
Students who have started a master’s degree by research or doctoral degree can work more than 48 hours per fortnight during study under the current guidance.
The exception begins after the course starts and applies to the eligible research programme. Check VEVO and provider records.
Work-integrated learning
A placement listed as a mandatory CRICOS course requirement can be treated differently from ordinary paid work. Optional work experience may still count toward the limit.
Obtain written confirmation from the provider and check Home Affairs guidance before starting.

The Visa Entitlement Verification Online service shows current visa conditions. Employers can also verify work rights with permission.
Use the official service and never give an employer the ImmiAccount password. A VEVO record is enough for the permitted check.
All workers have minimum rights
Fair Work says international students receive basic workplace rights and protections. Visa status does not permit an employer to underpay, threaten or provide an unsafe workplace.
Pay and conditions can come from the National Employment Standards, an award, an agreement and the employment contract.
Minimum pay
The lawful minimum depends on age, job, classification, award and employment type. Rates can change each year.
Use the Fair Work Pay and Conditions Tool. Do not accept a lower “student rate” unless it is lawfully part of the applicable rules.
Payslips
Study Australia says a payslip must normally be provided within one working day of pay. It records hours, rate, gross pay, deductions, tax and superannuation information.
Save every payslip and compare it with the roster and bank deposit. Ask in writing about a mismatch.
Cash payments
Being paid in cash is not automatically illegal, but the employer must still pay the lawful rate, issue a payslip, report tax and meet employment duties.
Cash without records can hide underpayment. Maintain a personal log and do not agree to false hours.
Tax file number
Apply for a tax file number through the Australian Taxation Office and give it to the employer through the proper declaration process.
A TFN is sensitive. Do not send it to an unverified recruiter or pay someone to obtain a free government number.
Superannuation
Eligible temporary workers receive employer superannuation contributions. Check the fund and amounts shown on payslips and account records.
After permanently leaving Australia, an eligible temporary resident may apply for a Departing Australia Superannuation Payment under ATO rules.
Casual, part-time and full-time work
Part-time employees usually have regular hours and pro rata paid leave. Casual employees lack a firm advance commitment and receive a casual loading or specific rate instead of some paid leave.
The label must reflect the real arrangement. A contract cannot remove minimum legal entitlements.
Unpaid trials and internships
A brief supervised demonstration of skills can be lawful, but productive work that benefits the business usually needs payment. Longer “trials” are a warning sign.
Course placements can have different rules. Confirm whether the activity is a mandatory vocational placement.
Independent contracting and ABNs
An employer cannot avoid employment duties simply by telling a worker to obtain an Australian Business Number. The real level of control, risk and independence matters.
Seek Fair Work or tax advice before accepting a contractor arrangement for an ordinary rostered job.
Workplace safety and workers compensation
Employers must provide a safe work environment and appropriate training. Workers should follow reasonable safety instructions and report hazards.
Workers compensation insurance can support an employee injured or made ill at work. Report incidents promptly and keep medical records.
If an employer demands excess hours
Remind the employer of the visa condition in writing and keep the roster. Do not accept hidden hours or a false payslip.
Fair Work explains that migrant workers can still seek help for pay and protections even when visa conditions may have been breached.
